Eleanor Donaldson to appeal trial of the facts verdict

Eleanor Donaldson has applied to appeal the verdict from her trial of the facts, with the Northern Ireland Courts Service confirming on Thursday that an application for leave to appeal had been lodged with the Court of Appeal by her legal team.

A trial on different terms

Donaldson faced a trial of the facts after being found unfit for a conventional criminal trial on mental health grounds. The proceedings ran alongside the trial of her husband, former Democratic Unionist Party leader Jeffrey Donaldson, at Newry Crown Court in May and June.

The trial of the facts is a legal mechanism used when a defendant is not well enough to stand trial in the ordinary way. It establishes whether the defendant did the acts alleged, without determining criminal guilt, because a person who is unfit cannot be convicted or sentenced in the normal sense. The outcome can lead to a treatment order or an absolute discharge, but not a prison sentence.

The court at Newry found that Donaldson had done the acts in relation to all five charges she faced. Four of those charges were of aiding and abetting the offending committed by her husband. Jeffrey Donaldson was convicted of 18 counts of sex abuse, including one count of rape, which he committed against two women when they were children.

What the appeal is about

An appeal against a trial of the facts verdict is not the same as a conventional criminal appeal. The Court of Appeal will first have to decide whether to grant leave to appeal, and the judge from the original trial is due to make a decision on the case in October. The Northern Ireland Courts Service said the application had been received, but it did not release further detail about the grounds on which Donaldson’s lawyers are challenging the outcome.

Jeffrey Donaldson’s solicitor has separately said he intends to appeal against his own convictions. That process is at an earlier stage and is separate from his wife’s application.

Why it matters

The Donaldson case has been one of the most politically charged criminal trials in Northern Ireland in recent years. Jeffrey Donaldson’s own appeal against conviction is running on a separate track, and further developments in both cases are likely in the weeks ahead.
